Terms and Conditions

Welcome to hotvoyage.ca (the “Website”). These Terms of Service (“Terms”) govern your access to the Website and the booking of sauna boat charter services (the “Services”). Your booking agreement is with Hot Voyage Floating Sauna Inc. (“we,” “us,” “our,” or the “Company”).

The Services are provided on a vessel owned by 1517471 B.C. LTD. (the “Owning Company”). “Protected Parties” means the Company, the Owning Company, the Vancouver Fraser Port Authority, municipal/provincial/federal authorities granting permissions, owners/lessors of docks or embarkation areas, and their respective directors, officers, employees, contractors, guides, agents, lessors, representatives, and volunteers.

By completing a booking and paying through our booking provider, you (the “Charterer”) represent you are at least 19 years of age and have authority for all Participants (“Guests”). You agree to these Terms for yourself and all Guests. IF YOU DO NOT AGREE, DO NOT BOOK.

Key Terms Summary (please read)

  • Age: All Guests must be 19 years of age or older; ID may be required.

  • Liability Waiver: Booking requires a mandatory checkbox agreeing to the Hot Voyage Liability Waiver (the “Release”), including the OWN-NEGLIGENCE term. Each Guest must e-sign the Release before departure or boarding is denied without refund.

  • Strict Cancellation Policy:

    • More than 10 days notice: 70% Refund (30% retained as non-refundable admin fee).

    • Less than 10 days notice: Non-Refundable (0% Refund).

  • Rescheduling: Allowed once if >10 days prior ($50 fee applies). Not allowed <10 days prior.

  • Gift Cards: Non-refundable and not redeemable for cash.

  • Liability Cap (booking issues): Capped at Charter Fee paid; injury claims governed by the Release.

  • Conduct & Safety: Crew may deny boarding/remove unsafe, impaired, or non-compliant Guests without refund.

By proceeding, you acknowledge these key terms.

1. Charterer’s Responsibility

You must be at least 19 years of age to book. You are responsible for ensuring every Guest is 19 years of age or older, complies with crew instructions, and for any damages caused by your group. We may require government photo ID before boarding. Guests under 19 years of age are not permitted to participate.

2. Booking Process and Mandatory Liability Waiver Requirement

Agreement at Booking. Before payment, you are presented with conspicuous notice that booking and participation are conditional on agreeing to the Liability Waiver (the “Release”), including the OWN-NEGLIGENCE term, and you indicate agreement by checking a required checkbox. The checkbox is unchecked by default and payment cannot be completed until it is checked. A working hyperlink to the full Liability Waiver is provided at checkout and remains available at hotvoyage.ca/liability-waiver/.

Scope of Release Coverage (passes/multi-visit). The Release covers the Guest’s entire visit/session, including staging, safety briefings, tender transfers, participation, and disembarkation. For any multi-visit product (e.g., passes), each Guest will re-confirm the Release at every visit before participating. We do not auto-renew any product beyond 60 days without separate advance notice and affirmative consent.

Post-Booking Waiver Distribution. After booking, the Release is sent electronically to the Charterer for distribution and completion by each Guest. The post-payment e-signature is a formal confirmation of the agreement already accepted at checkout.

Mandatory Signing Deadline & Consequences.

  • The Charterer must provide each Guest’s full name and valid email and ensure each person individually e-signs the Release.

  • All signed Releases are due prior to departure.

  • Failure to comply: Any Guest who has not e-signed by the time of departure will be denied boarding—no exceptions; no refunds or credits are provided for denied boarding due to non-signature.

  • Names on Releases must match government ID. Substitutions are permitted up to 24 hours before departure, provided the substitute completes the Release.

  • Authority: If you book for other Guests, you warrant you have authority to bind them to the Release and these Terms and you agree to circulate the Release immediately after booking.

Electronic Signatures & Records. Electronic signatures and records have the same legal effect as originals. You consent to our retention of records reasonably necessary to evidence notice and consent, including signature certificates, device/IP/time stamps, scroll/checkbox logs from checkout, boarding manifests, and photographs of posted dock/tender signage.

3. Conduct, Safety & Right to Refuse Carriage

For safety and regulatory compliance, the skipper/crew may, in their reasonable discretion, deny boarding or remove any Guest who appears intoxicated, impaired, aggressive, non-compliant with instructions, under 19 years of age, or otherwise unsafe. Removal/denial on these grounds is not a cancellation by the Company and no refund or credit is provided.

4. Charterer’s Acknowledgement of Key Terms

By proceeding with payment, you specifically acknowledge and agree that:

  • You agreed to the Release (including the OWN-NEGLIGENCE term) before payment by checking a required box.

  • It is your sole responsibility to ensure all waivers are signed by the deadline.

  • The Charter Fee is for private/exclusive vessel booking (not per-person).

  • If any Guest is denied boarding for failure to sign or for safety/non-compliance, no refund is provided.

  • You had sufficient time to read these Terms without duress or pressure and had the opportunity to seek independent legal advice.

5. Payments and Cancellation by Charterer

Payment. Prices are in CAD and exclusive of applicable taxes/fees unless stated otherwise. Full payment is required at booking to confirm your charter.

Payment Processing & Security. Payments are processed securely by third-party payment providers (e.g., Stripe, PayPal) via our booking platform (Bokun.io). Hot Voyage does not directly collect, store, or have access to your full credit card or banking information. By booking, you acknowledge that your transaction is subject to the applicable terms of service and privacy policies of these third-party processors. We are not responsible for any errors, declines, or data breaches caused by these third-party payment processors.

Cancellation by Charterer (Private Charters).

  • 10 Days or More Prior: Cancellations made 10 days (240 hours) or more prior to the scheduled departure time will receive a 70% refund of the Charter Fee. The remaining 30% is retained by the Company as a non-refundable administrative and booking guarantee fee.

  • Less Than 10 Days Prior: Cancellations made less than 10 days prior to the scheduled departure time are 100% non-refundable.

  • Approved refunds are returned to the original payment method; card-processor timelines apply.

Rescheduling by Charterer. You may request to reschedule your private charter date or time one time, subject to availability, provided the request is made at least 10 days (240 hours) prior to the scheduled departure.

  • Fee: A rescheduling administrative fee of $50 CAD (plus tax) applies to all approved changes.

  • Price Difference: If the new slot is more expensive, you must pay the difference. If cheaper, the difference is issued as store credit only.

  • Late Requests: Rescheduling requests made less than 10 days prior to departure are not permitted and are treated as a cancellation subject to the standard cancellation fees (100% non-refundable).

Gift Cards. Gift Cards are non-refundable and cannot be redeemed for cash, except where required by law. Lost or stolen cards will not be replaced.

Shared Session Tickets. Tickets for shared (non-private) sauna sessions are non-refundable and non-transferable.

Substitutions. You may substitute Guests up to 24 hours prior to departure, provided each substitute completes the Release by the signing deadline.

Chargebacks. You agree to first contact us to resolve disputes. Chargebacks for amounts governed by these Terms (including denied boarding for non-signature, safety reasons, or cancellations within the non-refundable window) constitute a breach of these Terms.

6. Operational Changes & Cancellation by Company

A. Force Majeure & Weather (Beyond Our Control) If we must cancel due to unsafe weather, marine conditions, Port Authority orders, or other “Force Majeure” events (as defined in Section 8), you will be offered the choice of:

  1. Rescheduling to a new date; or

  2. A Store Credit for the full value paid, valid for 12 months (or longer if required by law). In these specific Force Majeure circumstances, refunds are not issued. The skipper’s decision regarding safety/weather is final.

B. Operational Cancellations (Within Our Control) If we must cancel due to mechanical failure of our vessel, staffing shortages, or booking errors on our part:

  1. We will attempt to reschedule you to a mutually agreeable time.

  2. If rescheduling is not possible or desired, you will receive a full refund.

Transport on Public Roads. If any road transportation is offered, such transport is governed by applicable motor-vehicle insurance statutes and is not covered by the marine-activity Release.

7. Limitation of Liability and Indemnification

Limitation of Liability (booking issues). To the fullest extent permitted by law, the total aggregate liability of the Protected Parties for any claim relating to these Terms or the booking process is limited to the Charter Fee paid. (The comprehensive release for personal injury, death, and similar claims is governed exclusively by the separate, mandatory Release.)

Indemnification. The Charterer agrees to indemnify, defend, and hold harmless the Protected Parties from and against any and all claims, liabilities, damages, and costs including defence costs (legal fees on a solicitor-client basis), expert fees, disbursements, and settlement or judgment amounts arising out of (i) the Charterer’s breach of these Terms, or (ii) the conduct, negligence, or wilful misconduct of any Guest in the Charterer’s group.

No consequential damages. To the maximum extent permitted by law, we are not liable for indirect, special, incidental, punitive, or consequential damages, including loss of enjoyment or travel costs.

8. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, severe weather (high winds, waves, lightning), natural disasters, war, terrorism, government action, labour disputes, utility or communication failures, public health orders, epidemics/pandemics, and port closures or navigational restrictions.

9. General Provisions

  • Governing Law & Jurisdiction: These Terms are governed by the laws of British Columbia, and the parties attorn to the exclusive jurisdiction of the courts of British Columbia.

  • Severability: If any provision is invalid or unenforceable, the remainder continues in full force.

  • No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.

  • Entire Agreement & Priority: These Terms, the Liability Waiver/Release, and our Privacy Policy constitute the entire agreement. If there is a conflict between these Terms and the Release on issues of risk allocation, assumption of risk, or personal-injury claims, the Release governs.

  • Notices: We will send operational and legal notices to the email used for booking; you agree to keep contact details accurate.

  • Amendments: We may update these Terms by posting a new “Last Updated” date. Changes apply to bookings made after the effective date.

  • Consumer Rights: Nothing in these Terms limits non-waivable rights under the Business Practices and Consumer Protection Act (BC).
