  • Sensitive Health & Safety Information: Through our mandatory Liability Waiver, we collect declarations regarding specific medical conditions (e.g., heart conditions, epilepsy, pregnancy) solely for the purpose of assessing fitness for participation in sauna and marine activities.
  • Visual & Audio Media: Photographs or video recordings may be taken during charters for promotional purposes, subject to the consent terms outlined in our Terms of Service and Liability Waiver.
  • Technical Data: IP addresses, browser type, and cookies collected automatically when you visit our website for analytics and functionality.
  1. How We Use Your Information

We use your personal information for the following purposes:

  1. To Process Bookings: Verifying identity, processing payments, and sending confirmations or operational updates (e.g., weather cancellations).
  2. To Ensure Safety: Reviewing Liability Waivers to identify medical contraindications and ensure all guests meet the age requirement (19+).
  3. To Comply with Law: Retaining signed Waivers and passenger manifests as required by marine insurance policies and Transport Canada regulations.
  4. Marketing (with consent): Sending newsletters or promotions only if you have explicitly opted in. You may unsubscribe at any time.
  5. Media: Using photos/videos for social media and advertising, unless you have exercised your Written Opt-Out right as defined in our Liability Waiver.
  1. Protection of Sensitive Health Data

We recognize that the medical information provided on your Liability Waiver is sensitive. We apply strict safeguards to this data:

  • Limited Access: Only the Captain, Lead Crew, and Management have access to health declarations, and strictly for the purpose of safety management.
  • No Marketing Use: Health information is never used for marketing, shared with advertisers, or used for any purpose other than safety and liability defense.
  1. Disclosure to Third Parties

We will not sell, lease, or trade your personal information to other parties. However, we may share information with trusted service providers who assist our operations:

  • Booking & Payment Processors: Bokun.io, Stripe, and PayPal process your booking and payment data. They act as data controllers for financial information and operate under their own strict privacy policies.
  • Waiver Management: Digital waiver providers (if applicable) store your signed legal documents securely.
  • Legal & Emergency: We may disclose information to medical responders (in an emergency), insurers (in the event of a claim), or law enforcement (if compelled by a court order or to prevent illegal activity).
  1. International Data Transfer

Our primary service providers (Bokun, Stripe, PayPal) may process and store personal information on servers located outside of Canada (e.g., in the United States or Europe). While your information is outside Canada, it may be subject to the laws of that jurisdiction, including access by foreign government authorities.
